I-9 Compliance Update
The USCIS has revised the Employment Eligibility Verification Form I-9. The revised form, instructions and list of acceptable documents are attached to this e-mail. The Handbook for Employers, which contains general information and a lengthy Q & A regarding I-9 compliance, can be found at: www.uscis.gov As of November 7, 2007 only the current version of Form I-9 (2007 edition) may be used for new hires. All previous versions are no longer valid. Employers do not need to complete new forms for existing employees. However, employers must use the new form when reverification of employment eligibility is required. In an interesting change, the I-9 instructions now provide that an employee is not obligated to furnish a social security number when completing the I-9 form, unless he or she is employed by an employer who participates in the E-VERIFY program. The Handbook and USCIS website contain information about this program as well as electronic completion and storage of I-9 forms. For more information about I-9 compliance and employment eligibility verification please contact one of the attorneys in our office. Donald Jay Wolfson:
